1. Who We Are

LoadBounce™ is a trade name (DBA) of American Directional Driller, Inc., a Colorado C-Corporation located at 1500 N Grant St, Suite R, Denver, CO 80203. We are the data controller for personal information collected through the LoadBounce™ platform at loadbounce.ai.

2. Data We Collect

Account Data

• Name, email address, phone number
• Company or fleet name
• Billing address and payment method (processed by Stripe — we do not store card numbers)
• Account credentials (password stored as a salted hash)

Operational Data

• Vehicle information (make, model, year, VIN, license plate)
• GPS location data (latitude, longitude, speed, heading, timestamp)
• Load records (origin, destination, stops, cargo description, weight)
• BOL photos and uploaded documents
• Maintenance records and service intervals

Regulatory and Compliance Documents

• Regulatory documents and licenses you choose to upload (document type, expiration date)
• Third-party certification and screening records you choose to store
• Insurance and coverage information you choose to upload

Usage Data

• IP address, browser type, device type
• Pages visited, features used, session duration
• Error logs and performance metrics

Communications

• Emails and support messages you send to us
• Form submissions through the platform

3. How We Use Your Data

We do not use your data for automated decision-making that produces legal or similarly significant effects without human review.

4. GPS and Location Data

Location data is the core operational data of the LoadBounce™ platform. We treat it with particular care:

• Collection — Location is collected only when the LoadBounce™ driver app is active in the browser. Background tracking requires the driver to keep the page open.
• Storage — Location data is stored in our secure infrastructure (Standard tier) or our analytics platform (Enterprise tier).
• Sharing — Live location is shared only via shipper tracking links that you generate. These links are accessible to anyone with the URL. You control when to create and revoke tracking links.
• Retention — Historical GPS tracks are retained for the life of your active subscription and for 30 days after cancellation, then permanently deleted.
• Driver consent — Fleet operators are responsible for obtaining driver consent before enabling GPS tracking. See our Terms of Service for fleet operator obligations.

5. Data Sharing and Third Parties

We do not sell your personal data to third parties.

We share data only in the following limited circumstances:

Service Providers

Shipper Tracking Links

When you generate a shipper tracking link, the recipient can view live GPS location and load status without creating an account. You are responsible for distributing these links appropriately.

Legal Requirements

We may disclose your data if required by law, court order, or government request, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of LoadBounce™, our users, or the public.

Business Transfers

In the event of a merger, acquisition, or sale of all or substantially all of our assets, your data may be transferred to the acquiring entity. We will notify you before your data becomes subject to a different privacy policy.

6. Data Storage and Security

Your data is stored on secure infrastructure with data centers in the United States.

We implement industry-standard security measures including:

• TLS/HTTPS encryption for all data in transit
• Encrypted storage for sensitive data at rest
• Access controls and authentication requirements
• Regular security reviews and monitoring

No method of electronic transmission or storage is 100% secure. While we strive to use commercially acceptable means to protect your data, we cannot guarantee absolute security. In the event of a data breach that affects your personal information, we will notify you as required by applicable law.

7. Data Retention and Deletion

Account Deletion

You may request deletion of your account and all associated data by emailing [email protected]. We will process deletion requests within 30 days. Note that billing records required for tax and legal compliance will be retained for 7 years regardless of account deletion.

Post-Cancellation

Upon cancellation of your subscription, all operational data (GPS tracks, loads, driver records, BOL documents) is retained for 30 days to allow data export and potential reactivation. After 30 days, this data is permanently and irreversibly deleted. We strongly encourage you to export your data before or immediately after cancellation.

8. Your Rights

Depending on your location, you may have the following rights regarding your personal data:

For California Residents (CCPA)

• Right to Know — Request disclosure of the categories and specific pieces of personal information we have collected about you
• Right to Delete — Request deletion of personal information we have collected, subject to certain exceptions
• Right to Opt-Out — We do not sell personal information, so this right is not applicable
• Right to Non-Discrimination — We will not discriminate against you for exercising your CCPA rights

For EEA / UK Residents (GDPR)

• Right of Access — Request a copy of your personal data
• Right to Rectification — Request correction of inaccurate data
• Right to Erasure — Request deletion of your personal data
• Right to Restrict Processing — Request that we limit how we use your data
• Right to Data Portability — Request your data in a machine-readable format
• Right to Object — Object to processing based on legitimate interest

9b. SMS Communications

By providing your mobile phone number and creating a LoadBounce™ account, you consent to receive SMS text messages from LoadBounce™ (American Directional Driller, Inc.) including:

• Verification codes — One-time passcodes sent when you log in to your account
• Load status notifications — Proactive updates about your active loads, including estimated delivery windows (for subscribed plans)

Message and data rates may apply. Message frequency varies by account activity and subscription plan. To opt out of SMS notifications at any time, reply STOP to any message. To get help, reply HELP. For support, contact help@loadbounce.ai.

We use Twilio as our SMS service provider. Your phone number and message content are transmitted to Twilio solely for the purpose of delivering these messages. We do not use your phone number for marketing or share it with third parties for their marketing purposes.

9. Cookies and Tracking

LoadBounce™ uses the following cookies and local storage:

We do not use third-party advertising cookies. We do not use cross-site tracking. You may disable cookies in your browser settings, but this may affect the functionality of the Service.

10. Children's Privacy

The Service is intended for commercial fleet operations and is not directed at individuals under 18 years of age. We do not knowingly collect personal information from minors. If you believe a minor has provided us with personal information, contact us at [email protected] and we will delete the information promptly.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by email to your registered address at least 30 days before changes take effect. The "Effective Date" at the top of this page reflects the date of the most recent update.
